These Terms of Service ("Terms") govern your use of the Hollis & Vale website and your purchases from us. By using the site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.
In these Terms, "Hollis & Vale," "we," "us" and "our" mean [legal business name], doing business as Hollis & Vale.
1. Using our site
You agree to use the site only for lawful purposes. You may not misuse the site, try to access it without permission, interfere with its operation, or use it to submit false or misleading information. You must be at least 18, or the age of majority where you live, to place an order.
2. Products and descriptions
We try to show our products and colors as accurately as we can, but your screen may display colors differently. Leather is a natural material, so grain, tone, markings and small variations differ from piece to piece, and the color will deepen with use. These differences are part of its character and are not defects. Dimensions are approximate.
3. Personalized (engraved) orders
- Each engraved item is made to order from the text you provide at checkout.
- You are responsible for the accuracy of your engraving text, including spelling, spacing, punctuation and capitalization. We engrave exactly what you enter.
- Engraving is done in a set style, size and placement. Results may vary slightly with the leather's grain and texture.
- We may decline or cancel any engraving request that includes offensive, unlawful or infringing content (for example, trademarks or logos you don't have the right to use). If we do, we'll contact you and refund your order.
- Engraved items are final sale, except as described in our Refund Policy.
4. Pricing and payment
All prices are in [USD] and may change at any time without notice. Prices at the time you place your order are the prices you pay. Taxes and shipping are calculated at checkout. We may correct pricing errors and cancel orders affected by them, with a full refund. Payment is processed securely by our payment providers, and we do not store your full card details.
5. Orders and acceptance
Placing an order is an offer to buy. We accept it when we confirm it and begin production. We may refuse or cancel any order, including for suspected fraud, unavailable stock, or errors in pricing or product information, and we will refund any amount charged.
6. Production and shipping
Because items are made to order, production takes [X to Y business days] before shipping. Shipping times after that depend on the carrier and destination, and any dates we give are estimates, not guarantees. Risk of loss passes to you once the carrier delivers the package to the address you gave us, so please check your shipping address carefully. If a package is lost or delayed, contact us at 786-802-2986 and we'll help resolve it with the carrier.
7. Returns and refunds
Our Refund Policy is part of these Terms and explains returns, replacements and refunds, including the final-sale terms for personalized items.
8. Intellectual property
All content on this site, including the Hollis & Vale name, logo, photos, text and designs, belongs to us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use it commercially without our written permission. By submitting engraving text, you confirm you have the right to use it and that it doesn't infringe anyone else's rights.
9. Gift orders
If you buy an item as a gift, you are responsible for the engraving text and the shipping address. Gift recipients should contact us through the buyer or with the order number for any issue.
10. Disclaimer of warranties
Our products and site are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some places don't allow these exclusions, so some of them may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Hollis & Vale and its owners, employees and partners are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the order that gave rise to the claim. Nothing in these Terms limits liability that can't be limited by law.
12. Indemnification
You agree to defend and hold us harmless from claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third party's rights, including through the engraving text you submit.
13. Privacy
Our Privacy Policy explains how we collect and use your information. By using the site, you agree to that policy.
14. Third-party services and links
The site may link to or rely on third-party services (payment processors, carriers, analytics). We aren't responsible for their content, practices or availability.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows when. Continued use of the site after changes means you accept them. Orders are governed by the Terms in effect when you placed them.
16. Governing law and disputes
